{"id":1334,"date":"2011-07-08T11:41:20","date_gmt":"2011-07-08T16:41:20","guid":{"rendered":"http:\/\/www.davidmcelroy.org\/?p=1334"},"modified":"2011-07-08T11:45:30","modified_gmt":"2011-07-08T16:45:30","slug":"grow-veggies-in-your-own-yard-youre-heading-to-jail-you-criminal","status":"publish","type":"post","link":"https:\/\/davidmcelroy.org\/?p=1334","title":{"rendered":"Grow veggies in your own yard? &#8216;You&#8217;re heading to jail, you criminal&#8217;"},"content":{"rendered":"<p><a href=\"http:\/\/www.davidmcelroy.org\/wp-content\/uploads\/2011\/07\/Veggie-garden.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-1340\" title=\"Veggie garden\" src=\"http:\/\/www.davidmcelroy.org\/wp-content\/uploads\/2011\/07\/Veggie-garden.png\" alt=\"\" width=\"250\" height=\"184\" \/><\/a>City officials in the Detroit suburb of Oak Park apparently have so little to do that they&#8217;re <a href=\"http:\/\/www.myfoxdetroit.com\/dpp\/news\/local\/julie-bass-of-oak-park-faces-misdemeanor-charge-for-vegetable-garden-20110630-wpms\" target=\"_blank\">taking the time to prosecute a woman<\/a> for the dastardly crime of growing vegetables in some well-tended areas of her front yard.<\/p>\n<p>This is a perfect companion to <a title=\"Practically and legally, it\u2019s true: \u2018Good fences make good neighbors\u2019\" href=\"http:\/\/www.davidmcelroy.org\/?p=1319\" target=\"_blank\">what I wrote Thursday<\/a> about the need for &#8220;legal fences&#8221; that keep other people from telling us what to do on our own property. I was thinking more of free cities &#8212; and of one group not being able to tell another what to do &#8212; but it comes down to the same issues: choice and property rights.<\/p>\n<p>In the Detroit case, Julie Bass faces 93 days in jail for having a small vegetable garden in her yard, because the city says she&#8217;s in violation of the city regulation that says front yards must have &#8220;suitable&#8221; vegetation. Bizarrely, the city has taken the position that this word only means &#8220;common,&#8221; so Bass is only allowed to have grass, trees and flowers that are common in other yards. (For the record, none of <a href=\"http:\/\/www.merriam-webster.com\/dictionary\/suitable\" target=\"_blank\">the dictionaries I checked<\/a> agreed with the city.)<\/p>\n<p><!--more-->The problem is that the statist system is &#8220;one size fits all.&#8221; Politicians and bureaucrats make rules for everyone, and the majority can force its will on the minority whenever it wants about most things. It&#8217;s perfectly reasonable if people want to live in a community without vegetable gardens in the front yard or neighborhoods where flagpoles aren&#8217;t allowed or communities where every house has to be painted with pink and purple polka dots. But people should have a choice about that. It should be part of the known rules from the beginning &#8212; and it should be perfectly acceptable for different communities or cities to adopt different rules, whether they&#8217;re about foliage, architecture, safety or labor rules.
