{"id":3020,"date":"2011-08-22T12:15:37","date_gmt":"2011-08-22T17:15:37","guid":{"rendered":"http:\/\/www.davidmcelroy.org\/?p=3020"},"modified":"2011-08-22T12:15:37","modified_gmt":"2011-08-22T17:15:37","slug":"overthrow-of-gaddafi-no-justification-for-attacks-on-other-countries","status":"publish","type":"post","link":"https:\/\/davidmcelroy.org\/?p=3020","title":{"rendered":"Overthrow of Gaddafi no justification for attacks on other countries"},"content":{"rendered":"<p><a href=\"http:\/\/www.davidmcelroy.org\/wp-content\/uploads\/2011\/08\/Gaddafi.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-3022\" title=\"Gaddafi\" src=\"http:\/\/www.davidmcelroy.org\/wp-content\/uploads\/2011\/08\/Gaddafi.jpg\" alt=\"\" width=\"250\" height=\"225\" \/><\/a>Now that the <a href=\"http:\/\/www.reuters.com\/article\/2011\/08\/22\/us-libya-gaddafi-whereabouts-idUSTRE77L2X220110822\" target=\"_blank\">dictatorial regime of\u00a0Muammar Gaddafi is ending<\/a>, we&#8217;re starting to see some people <a href=\"http:\/\/www.politico.com\/arena\/archive\/president-obama-vindicated-on-libya.html\" target=\"_blank\">suggest that the outcome is a vindication of Barack Obama&#8217;s policy in Libya<\/a>.<\/p>\n<p>Let&#8217;s review the facts. First, Gaddafi was a dictator and he wasn&#8217;t an especially sane or pleasant man. Second, there are plenty of other countries run by unpleasant men. (They almost always seem to be men, don&#8217;t they?) Third, Libya had not attacked the United States or any other country.<\/p>\n<p>Under these circumstances, there&#8217;s no sane reason for the United States (and other foreign powers) to send their military forces into the country to topple the government. It might make us all feel better &#8212; at least until the next guy becomes Dictator of the Week and arouses an outcry.<\/p>\n<p><!--more-->Even if the United States were going to invade Libya, there&#8217;s only one legal mechanism to make that immoral decision. In Article 1, Section 8 of the U.S. Constitution, it says:<\/p>\n<blockquote><p>&#8220;The Congress shall have power &#8230;\u00a0To\u00a0declare War&#8230;.&#8221;<\/p><\/blockquote>\n<p>It doesn&#8217;t say anywhere that the president can run around the world invading countries he feels should be invaded &#8212; if he&#8217;ll simply call them liberations or &#8220;police actions&#8221; or any of the other euphemisms employed by politicians to obscure what they do. Unfortunately, U.S. president have been ignoring that prohibition &#8212; and Congress and the courts have been allowing it &#8212; for at least the last hundred years. In effect, the U.S. president has become a dictator when it comes to war.<\/p>\n<p>This administration has argued that <a title=\"Redefining words: Contrary to what you think, it\u2019s not hostile to bomb cities and kill people\" href=\"http:\/\/www.davidmcelroy.org\/?p=1056\" target=\"_blank\">U.S. military forces weren&#8217;t engaged in &#8220;hostilities&#8221;<\/a> and the president conveniently listened to the <a title=\"Blind political loyalty almost always leads to intellectual dishonesty\" href=\"http:\/\/www.davidmcelroy.org\/?p=2268\" target=\"_blank\">one administration lawyer he could find who said what he wanted<\/a>, rather than the others who read the law as it was written. Given the Gaddafi was a dictator with few limits, how exactly does this make him different from Obama on this issue? They&#8217;re both unilateral dictators.<\/p>\n<p>Things might end up better in Libya with Gaddafi gone, but it&#8217;s hard to say. Who knows what might take his place? But even if Libya becomes a model of the modern peaceful and happy democratic state, what Obama did on Iraq was illegal and immoral.
